Shopin.club online store user agreement

Definitions of terms.
"Buyer" - an individual who uses, acquires or orders or intends to use, purchase or order movable things (works, services) for personal, family, household and other needs not related to business activities, who placed an order on the shopin website. club, or indicated as the recipient of the goods.

"Seller" - Rombello d.o.o. (registration number 8198306000, VAT ID - SI 60307609, address Malija 65B, 6310 Izola/Isola, Slovenia), which sells goods on the shopin.club website.

"Online store" - a site where the Buyer can get acquainted with the goods, their descriptions, prices, select a specific product, method of payment and delivery, place an order or purchase independently on the site.

The "Site" is located on the domain shopin.club, owned by Rombello d.o.o.

"Product" - an item of sale, provided for purchase in the online store, by placing it in the appropriate section of the online store. The subject of purchase and sale can only be Goods that have the status "in stock" in the online store.

"Order" - the Buyer's request in electronic form in the Online Store for the purchase and delivery to the address indicated on the Site by the Buyer of the Goods selected in the Online Store, sent via the Internet.

"Delivery Service" - a legal entity and / or an individual entrepreneur providing services for the delivery of Orders to Buyers under an agreement with the Seller.

General provisions.
2.1. This "User Agreement of the shopin.club online store" (hereinafter referred to as the "Rules") is an official public offer (hereinafter referred to as the "Offer Agreement"). The Seller and the Buyer are collectively referred to as the "Parties", and each individually as the "Party".

2.2. Each Party guarantees to the other Party that it has the necessary legal and legal capacity, all the rights and powers necessary and sufficient for the conclusion and execution of the contract of sale.

2.3. The Buyer agrees to these Rules by registering on the site, as well as by clicking on the "Place an order" button when placing an Order on the site.

2.4. The Seller reserves the right to unilaterally amend these Rules, and the Buyer undertakes to regularly monitor changes in the Rules posted on the shopin.club Online Store page under the heading "Shopin.club Online Store User Agreement"

Registration process in the online store.
3.1. Buyers registered on the site shopin.club can place an Order in the online store.

3.2. The Seller is not responsible for the accuracy and correctness of the information provided by the Buyer during registration.

Registration and terms of the Order.
4.1. The order can be placed by the Buyer independently, via the Internet on the Site. Ordering goods by phone, e-mail without registration on the Site is not provided. In some cases, it is possible to order an individual product that is not available on the Site according to the store data specified in the "Contacts" section.

4.1.1. When placing an Order via the Internet, the Buyer fills out an electronic Order form in the Online Store and sends the Order to the Seller via the Internet and the Site interface.

4.1.2. You can only order Products that are in stock at the time of ordering.

4.2. To place an order, the Recipient must provide the following correct information on the Online Store Website:

- Name;

- surname;

- delivery address and mobile phone;

4.2.2 Additional data may be requested by the payment system through which the Payment is made. Additionally, the following information may be requested:

- passport data;

- social Security number;

- other data.

4.3. If during the processing of the Order it was discovered that the Seller does not have the required amount of the Goods in stock, the Seller informs the Buyer about this by phone, e-mail or in another way. The Buyer has the right to agree to accept the Goods in the quantity available from the Seller with the corresponding recalculation of the cost of the Order, or to remove this position of the Goods from the Order. In the absence of a response from the Buyer within 3 (three) calendar days from the date the notification was sent by the Seller, it is considered that the Buyer has refused to complete the Order.

4.4. If the Buyer has any questions regarding the properties, characteristics of the Goods, as well as other information about the Goods, before placing the Order, the Buyer is obliged to contact the Seller by phone +386 699 70531 (WhatsApp, Viber) daily from 9 a.m. until 21:00 CET.

4.5. The Offer Agreement is considered concluded from the moment the Order is placed by the Buyer.

Payment, Prepayment and Storage of Goods.
5.1. The price of the Goods is indicated on the corresponding page of the specific Goods in the online store.

5.2. The price of the Goods may be changed by the Seller unilaterally. The price of the goods, in relation towhich the Order has already been placed cannot be changed.

5.3. Payment for the Goods by the Buyer shall be made in euro or other currency. For settlements in a currency other than the euro, the bank's purchase rate of such currency is used, set by the Buyer's bank in relation to the payment currency at the time of payment or the exchange rate of the payment system.

5.4. At the request of the Buyer, a partial prepayment for the order of the Goods for the reserve of the Goods for up to 90 days can be made.
5.5. Until full payment for the Goods, it is with the Seller.

5.6. The amount of partial prepayment is included in the price of the Goods when the Buyer pays for its full cost.

5.7. In the event that the Buyer refuses the ordered and partially prepaid Goods, as well as in case of non-payment of the full cost of the Goods within a period of more than 60 days from the date of prepayment, the amount of the prepayment for the Goods shall not be returned or offset against payment for another Goods.

5.8. In the event that the Buyer pays an advance payment for the Goods, which are not available on the site, until the Seller buys the Goods from the supplier, clause 5.7. The Agreement does not apply, the validity period of the prepayment is not limited in time and, at the request of the Buyer, the preorder can be canceled at any time, and the cost of the prepayment can be exchanged for a coupon for the full value of the paid prepayment, which the Buyer can use as a discount when purchasing any other Product on the site.
From the moment the Goods are redeemed by pre-order from the supplier by the Seller, clause 5.7 is valid. Agreements.

5.9. Storage of the paid or prepaid Goods by the Seller is free of charge for the Buyer within 60 days from the date of payment or prepayment for the Goods.

5.10. Starting from the 61st day from the date of payment or prepayment of the Goods, a fee of 1 (one) euro is charged for the storage of the Goods in the Seller's warehouse for each calendar day of storage of one unit of the Goods in the Buyer's order until the day of dispatch.

5.11. If the Buyer refuses to pay the cost of storing the Goods in the Seller's warehouse, at the moment the payment for storing the Goods in the Seller's warehouse exceeds the cost of the Goods paid by the Buyer, the Goods become the property of the Seller, to pay off the Buyer's debt for storing the Goods in the Seller's warehouse. The paid price of the Goods is not subject to compensation.


Delivery.
6.1. The cost of delivery is paid by the Buyer, according to the tariff set by the Seller.

6.2. Goods are dispatched from the Seller's warehouse in Slovenia or from the supplier's warehouse in another country of the European Union.

6.3. Average delivery times are about 14 days. The exact delivery time depends on the country and region, as well as the time required for processing the Order by the Seller and / or the Delivery Service.

6.4. Shipping methods:

Air international mail with a tracking number - the parcel will arrive at your post office, at the address specified by the Buyer.

6.4.1. The Buyer undertakes to independently track the shipment to the Recipient using the track number provided to him on the website of the postal service of his country.

Return of goods and refunds.
7.1. When exchanging and returning the Goods of inadequate quality, the Buyer is obliged to contact the Seller by phone +386 699 70531, + 7 916 238 0291 (Whatsapp, Viber) or e-mail.

7.2. The term for returning the money to the Buyer takes 14 days from the date of receipt of the Goods by the Seller in the case of complain. 

The term for complain for the returning the Goods to the Seller is limited by 14 days from the date of receipt of the Goods by the Buyer.

7.3. Refund in case of return of the Goods and acceptance of the Goods by the Seller is carried out through the payment system used to make payment to the same card with which the payment was made, or in the form of a discount coupon in the amount of the cost of the Goods.

Warranties and liability.
8.1. The Seller is not responsible for damage caused to the Buyer as a result of improper use of the Goods purchased in the Online Store.

8.2. The Seller is not responsible for the Buyer's losses resulting from:

- incorrect indication by the Buyer of personal and other necessary data;

- illegal actions of third parties.

8.3. The Buyer undertakes not to use the Goods for business purposes.

8.4. The Buyer bears full responsibility for the accuracy of the information specified by him during registration on the Website of the Online Store.

8.5. The Parties are released from liability for full or partial failure to fulfill their obligations if such failure was the result of force majeure circumstances that arose after the entry into force of the Rules, as a result of extraordinary events that the Parties could not foresee and prevent by reasonable measures.

Confidentiality and protection of personal information, including requirements for the protection of personal data established by international law, including the GDRP (General Data Protection Regulation)
9.1. Providing information by the Buyer:

9.1.1. To place an order in the Online Store, the Buyer indicates and uses the following information: password to access the Online Store, First Name, Last Name, email address, contact phone number, delivery address. Information is stored in encrypted form on serverslaid down in the EU.

9.2. Use of information provided by the Buyer and received by the Seller:

9.2.1. The information received from the Buyer is used on the Site:

- to register the Buyer in the online store;

- to fulfill obligations to the Buyer and the delivery service;

- for declaring and customs clearance of the parcel;

- to evaluate and analyze the work of the online store, the formation of a database of Buyers of the online store;

9.2.2. The Seller has the right to send messages of an advertising and informational nature to the Buyer. If the Buyer does not wish to receive advertising and informational messages from the Seller, then he must refuse to receive such messages by clicking on the "unsubscribe" link located at the bottom of any informational message of the Seller.

9.3. Disclosure of information received by the Seller:

9.3.1. The Seller undertakes not to disclose the information received from the Buyer. It is not considered a violation that the Seller provides information to agents and third parties acting on the basis of an agreement with the Seller in order to fulfil obligations to the Buyer.

9.4. The seller has the right to use cookies technology (cookies - service information sent by the web server to the user's computer to be stored in the browser. It is used to save data specific to this user and used by the web server for various purposes - storing data to simplify repeated purchases, analytical sales data, various site functions for user convenience). Cookies do not contain confidential information and are not shared with third parties.

9.5. The Seller receives information about the IP address of the Site visitor. This information is not used to identify the visitor.

9.6. Terms of storage of information received: information received from the Buyer can be stored for up to 6 years in accordance with the requirements of the legislation of different countries on the storage of reporting documentation.

9.7. Information about the Buyer can be deleted at the request of the Buyer sent to the email address info@shopin.club

Other conditions.
10.1. The Buyer guarantees that all the terms of these Rules are clear to him and he accepts them unconditionally and in full.
